Terms of Use

BareInvestfolio · Silicon Hallway Pty Ltd · Version 1 · Effective 1 July 2026

These terms are an agreement between you and Silicon Hallway Pty Ltd (ABN 76 680 069 265) ("we", "us") about your use of the BareInvestfolio app (the "app"). By tapping "I agree" in the app, or by installing or using it, you accept these terms. If you do not agree, please do not use the app.

1. Who can use the app

You must be at least 13 years old. If you are under 18, you may use the app only if a parent or guardian has read and agreed to these terms and the Privacy Policy for you. If you use the app for a business, you confirm you may agree to these terms for it.

2. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own personal or internal business use, under these terms and the rules of the app store you got it from. You may not sublicense, rent, resell or distribute the app.

3. The app is a tracking tool, not advice

BareInvestfolio helps you record and view your own investments. It does not provide financial, investment, legal, accounting or tax advice, does not recommend any asset, and does not buy, sell or trade for you or connect to your brokerage. Prices, charts, performance figures, currency conversions and the tax report are calculated from what you enter and from third-party data, and are for information only. They can be wrong, delayed, incomplete or based on assumptions that do not fit your circumstances (including cost-base methods and tax rules). Check anything that matters against your statements and get advice from a qualified professional before making a financial or tax decision. You make your own decisions and bear their results.

4. Your data

Your portfolio data stays on your device and we do not receive it (see the Privacy Policy). You own it. This means you are responsible for keeping your device secure and for backing up your data, for example using the app's export feature and your device's backup. If you delete the app or a profile, or lose or reset your device, we cannot recover your data. You are responsible for the accuracy of what you enter or import, and for importing only data you are entitled to use.

5. Third-party data and services

The app fetches market data, exchange rates and logos from third-party providers (listed in the Privacy Policy). We do not control them, do not guarantee that their data is accurate, timely or available, and they may change or stop at any time. Data is provided for your personal use only; you must not copy, redistribute or resell it. Their own terms apply to their data.

6. Pro subscription

Some features need a paid Pro subscription. Purchases are made through the Apple App Store or Google Play, which handle payment, renewals, receipts and refunds under their own terms; we never receive your card details. Unless the store says otherwise, a subscription renews automatically at the end of each period at the price shown until you cancel in your store account settings, at least 24 hours before renewal. Deleting the app does not cancel a subscription. Refunds are handled by the store and are subject to your rights under the law. We may change prices or Pro features with notice in the app or store; a change applies from your next renewal. If your subscription ends, Pro features stop but the data you entered stays on your device.

7. Acceptable use

Do not: use the app unlawfully; reverse engineer, decompile or modify it except where the law allows; remove or bypass security or licensing features; send automated or excessive requests to our servers or try to get Pro features without paying; interfere with or try to gain unauthorised access to our services or other people's data; or use the app to harm others.

8. Our rights and open source

The app, its design, text and code are owned by us and our licensors and protected by intellectual property law. Nothing in these terms transfers any of those rights to you. The app includes open source software under its own licences, which you can read in the app (Settings > Open source licences); those licences apply to that software. If you send us feedback, you allow us to use it without payment or obligation.

9. Availability, changes and ending

We try to keep the app and Pro services running but they may be unavailable, interrupted or change, and we may update, add or remove features, or stop the app or any server it depends on, with reasonable notice where we can. You can stop using the app at any time by uninstalling it. We may suspend or end your access to Pro services if you seriously or repeatedly breach these terms. Sections that by nature should continue (including 3, 4, 5, 10, 11 and 12) continue after these terms end.

10. Disclaimers

To the extent the law allows, the app and all data and services are provided "as is" and "as available", and we do not promise that the app will be error-free, uninterrupted, secure, suitable for your needs, or that its calculations, prices or reports are accurate or complete.

Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, that you have under that law or other laws that cannot lawfully be excluded. If you are a consumer and the app fails to meet a guarantee, you may be entitled to a remedy such as a refund or repair.

11. Limits on our liability

To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of profits, investment returns, data or opportunity, or for any loss arising from decisions you make using the app, from errors or delays in third-party data, from a lost, stolen or damaged device, or from a failure to back up. Where the law allows us to limit our liability for a breach of a guarantee that cannot be excluded, we limit it, at our choice, to resupplying the service or paying the cost of having it resupplied. Otherwise, our total liability to you for all claims about the app is limited to the amount you paid us (through the store) in the 12 months before the claim, or AUD 100 if you paid nothing. Nothing here limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.

12. App store terms

If you got the app from the Apple App Store: these terms are between you and us, not Apple; Apple has no obligation to provide support or maintenance, and if the app does not meet a warranty, you may tell Apple to refund the purchase price and, to the extent the law allows, Apple has no other warranty obligation; we (not Apple) are responsible for claims about the app, including product liability, legal or regulatory compliance and intellectual property infringement claims; you confirm you are not in a country subject to a US embargo or on a US restricted list; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you got the app from Google Play, Google Play's terms also apply and Google is not responsible for the app.

13. Privacy

Our Privacy Policy explains what information the app uses and sends. You can read it at https://www.siliconhallway.com.au/bareinvestfolio/privacy and in the app.

14. Changes to these terms

We may update these terms. We will change the version and date above and, for a material change, ask you to agree again in the app before you continue. If you do not agree to a change, stop using the app (you keep your data on your device).

15. General

These terms, with the Privacy Policy, are the whole agreement about the app. If a part is unenforceable the rest continues. Not enforcing a right is not giving it up. You may not transfer your rights; we may transfer ours as part of a sale of the business. These terms are governed by the law of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts, without affecting any consumer rights under the law of the place you live. Please contact us first at the email below and we will try to resolve the problem within 5 business days.
